Divorce, in the State of Colorado, is the "dissolution" of a legally recognized marriage. Colorado is one of very few states still to recognize common law marriages. It recognizes the marriages of all 50 states with the exception of same-sex marriages from Massachusetts.
A divorce proceeding is initiated by the filing of a Petition for Dissolution. A Petition must be personally served on the other spouse. After service of the Petition, the other spouse may file a Response, stating what action they would like the Court to take. The Court must then wait a minimum of 90 days before it may finalize a divorce. A divorce is finalized by the entry of a Decree of Dissolution of Marriage by a District Court Judge or Magistrate.
